The Peoples Democratic Party (PDP) has filed a suit at the Federal High Court in Abuja, seeking the removal of Oluwole Oke, the lawmaker representing Obokun/Oriade Federal Constituency in Osun State, for defecting to the All Progressives Congress (APC).
The suit, filed on Monday by the party’s lead counsel, Raphael Oyewole, calls on the court to issue an order of mandamus compelling the Speaker of the House of Representatives, Tajudeen Abbas, to declare Oke’s seat vacant.
According to the PDP, Oke’s defection violates Section 68(1)(g) and (2) of the 1999 Constitution (as amended), as he switched parties without any evidence of division, merger, or faction within the PDP.
Oke, a six-term federal lawmaker, formally resigned from the PDP in a letter dated April 16, addressed to the party chairman in Ward 7, Obokun Local Government Area of Osun State. Copies of the letter were also sent to the PDP’s national and state leadership.
In the letter, Oke cited consultations with political associates, friends, and family as the basis for his decision to join the APC.
In response, the PDP named Oke, Speaker Abbas, the Clerk of the National Assembly, and the Independent National Electoral Commission (INEC) as the first to fifth defendants in the suit, marked FHC/ABJ/CS/1040/2025.
The party posed seven legal questions for the court’s consideration and is seeking eight specific reliefs.
One of the core questions asks whether, under Section 68(1)(g) of the Constitution, a legislator who defects from the political party that sponsored their election, without any justifiable constitutional grounds, is not bound to forfeit their seat.
Among the reliefs sought, the PDP is asking the court to compel Speaker Abbas and INEC to declare the Obokun/Oriade seat vacant and commence the process for a bye-election.
It also requested that the Clerk of the National Assembly immediately cease all payments of salaries, allowances, and entitlements to Oke.
Furthermore, the party is seeking a court order mandating Oke to refund all salaries and benefits received from the date of his resignation from the PDP to the date of judgment, describing his continued stay in office as unconstitutional.
