The N50 billion suit filed against the Federal Government of Nigeria and the Attorney General of the Federation (AGF) by the leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu has been struck out by the court.
Justice Inyang Ekwo of Federal High sitting in Abuja struck out the fundamental rights enforcement suit filed by Kanu on Thursday, April 10.
Delivery his ruling, Justice Ekwo said the detained IPOB leader and his counsel failed to appear before the court on three consecutive adjourned dates.
“Now the matter comes up today, plaintiff is absent, not represented by counsel and no excuse or reason is given for the absence
“There should be an end to indulgence by the court. My opinion is that this matter has been abandoned and ought to be so treated,” the judge said.
He further ruled that he was striking out Kanu’s suit marked FHC/ABJ/CS/462/2022 for want of diligent prosecution
Recall that Kanu had accused the Nigerian government and the AGF of violating his fundamental human rights following his arrest in Kenya.
Kanu who claimed he was kidnapped by the Nigerian government, sought 11 reliefs from the court, including an order for his immediate release from the Department of State Services (DSS) custody.
He also prayed the court to make restraining orders against the defendants from taking any further step to prosecute him over the charges of treason slammed on him by the DSS.
