Kato Crews, nominee for President Joe Biden’s trial, was at a loss while questioning Senator John Kennedy during testimony at Wednesday’s confirmation hearing.
Crews, a nominee for district judge for the U.S. District Court of Colorado, was asked by Kennedy how he would “analyze a Brady motion,” with Crews responding that during his forty-four he “didn’t have an opportunity to address a Brady motion.” . half a year in the bank.
After stumbling upon the answer, Kennedy, R-La., asked Crews if he knew “what a Brady motion is.”

Crews, who currently serves as a magistrate, admitted the concept “didn’t cross his mind” because he had never dealt with the subject before, prompting Kennedy to ask if Crews would take on the case Brady v. Maryland Supreme Court recalled and held what case.
“I believe the Brady case had something to do with the Second Amendment,” Crews replied. “I haven’t had a chance to address that.”
A Brady motion is a legal concept that was the result of the Supreme Court’s landmark 1963 decision Brady v. Maryland, which found that prosecutors must turn over potentially favorable evidence to the defense.

The exchange marked the second time this year that Kennedy stunned a Biden court nominee during confirmation hearings, less than two months after the Louisiana senator questioned Spokane County Superior Court Justice Charnelle Bjelkengren on Article V of the Constitution.
“Tell me what Article V of the Constitution does,” Kennedy asked Bjelkengren at that hearing.
“Article V doesn’t come to mind at the moment,” Bjelkengren replied.

Kennedy then asked Bjelkengren about Article II, with the candidate again responding that the article had not occurred to him.
Crews has been on the bench in his current role since 2018.
